These terms are the agreement between you and Prove Your Pick (“we”, “us”) for using proveyourpick.com and its app (the “service”). By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
1. What the service is
Prove Your Pick is a free game. You record stock picks with a target price and a date, and everyone can see how they turn out. The money in the game, including the $1,000,000 you start with, is pretend. It is not real money, it cannot be withdrawn, and no real stocks are bought or sold.
2. Not financial advice
Nothing on the service is financial, investment, tax or legal advice. Picks, comments, news, filings summaries and anything else here are opinions or information only. Prices and data may be late or wrong. Do your own research. You are responsible for any real investment you make, and we are not liable for any loss.
3. Who can use it
You must be at least 13 years old to create an account. To win a prize you must also meet the eligibility rules for that prize, which may require you to be 18 or older and live in the United States.
4. Your account
- Give us a real email address and keep your password private.
- One account per person. Do not pretend to be someone else.
- You are responsible for what happens on your account.
- Usernames that are offensive, misleading or impersonate someone may be changed or removed.
5. What you post
Your picks, targets, reasons, comments, votes, username and profile picture are public. A pick cannot be edited after you lock it in; that is the point of the game. You keep ownership of what you post, and you give us a free, worldwide licence to store, show and share it as part of the service, including in share images and on social media.
Do not post anything that:
- is illegal, threatening, hateful or harassing;
- tries to pump, dump or otherwise manipulate a real stock price;
- shares inside information or someone else's private information;
- is spam, advertising or a scam;
- infringes someone else's copyright or trademark.
6. Playing fairly
Do not cheat. That includes using more than one account, using bots or scripts, exploiting bugs, or trying to get into parts of the service you are not meant to. We can remove picks, reset scores, take away prizes and close accounts that break these rules.
7. Prizes and contests
Contests such as the quarterly championship have their own official rules, which apply alongside these terms. No purchase is necessary. The championship rules are at proveyourpick.com/rules.
8. Sponsors
Parts of the service may be sponsored, for example by The Finance Guide. A sponsor does not endorse any pick, and a link to a sponsor takes you to a site we do not control.
9. Changes and ending your account
The service is new and will change. We can add, change or remove features, or stop the service. You can stop using it at any time and ask us to delete your account. We can suspend or close an account that breaks these terms. If we change these terms in a way that matters, we will update the date at the top, and using the service afterwards means you accept the new version.
10. No warranty and limits on liability
The service is provided “as is”, without any warranty. We do not promise it will always work, be accurate or be available. As far as the law allows, we are not liable for any indirect or consequential loss, or for any investment loss, and our total liability to you is limited to $100.
11. The law that applies
These terms are governed by the laws of the State of Michigan, USA. Any dispute will be handled in the courts of Michigan, unless the law where you live says otherwise.
